Negotiating a Six-Figure Refund

A long-term disability carrier wanted to share the profits of their long-term disability business, but there was one sticking point: most of the profits were realized by a turnkey quota share reinsurer. We provided a detailed financial and actuarial review of the reinsurance structure and identified three changes that would deliver the greatest impact to their bottom line: changing the risk structure, modifying the expense allocation, and adding an experience refund.


Our client instructed us to negotiate with the reinsurer to add an experience refund to the existing reinsurance contract, driven by their desire to share the profits of their long-term disability business without increasing their risk position. Although experience refunds are not widely accepted by turnkey reinsurers, we succeeded in adding the experience refund to the existing contract and negotiated the refund to apply retroactively—resulting in our client receiving an immediate six-figure refund.
